Terms of Service

These terms are an agreement between you and Fiber Education, a sole proprietorship based in Kentucky, United States ("we", "us", "our"), covering your use of the Fiber Color Code application and website (the "Service").

By creating an account or using the Service, you agree to these terms. If you are agreeing on behalf of a company, you confirm you have authority to bind that company, and "you" means that company.

1. The Service

Fiber Color Code helps fiber optic technicians build, manage, and share splice plans, track work orders and time, attach photos and signatures, and produce as-built documentation. We may add, change, or remove features over time. If we remove something you depend on materially, we will give reasonable notice.

Work is organized into organizations and teams. Roles (owner, admin, member) determine what each person can do.

4. Your content

You own your data. Splice plans, photos, signatures, customer records, work orders, and time entries remain yours. You grant us only the limited license needed to host, process, back up, and display that content in order to operate the Service for you. We claim no other rights. We do not use your content for advertising or to train machine learning models.

You are responsible for having the right to upload what you upload, including photographs taken on a customer's premises.

6. Plans, billing, and refunds

Prices may change; we will give notice before a change affects a renewal. Fees exclude taxes unless stated.

Where you bought matters. Purchases made on the web are processed by Stripe and you may cancel from the billing portal. Purchases made in the iOS or Android app are processed by Apple or Google, and cancellations and refunds are governed by their policies and must be requested through them — we cannot refund a store purchase directly.

If a subscription lapses, your workspace becomes read-only. We do not delete your data because you stopped paying. You keep access to read and export it.

7. Availability

We aim to keep the Service running but do not promise uninterrupted availability. The app is designed to work offline and sync when you reconnect, but you should not rely on it as your only copy of critical records. Export important as-builts.

8. Termination

You may stop using the Service and delete your account at any time — see deleting your account. We may suspend or terminate access if you materially breach these terms, if required by law, or if we discontinue the Service. If we discontinue it, we will give reasonable advance notice and a window to export your data.

9. Disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Verify your splice plans. The Service computes fiber assignments and color codes from the information you enter. It is a professional aid, not a substitute for your own verification. You remain responsible for confirming that any plan, as-built, or report is correct before relying on it in the field or delivering it to a customer.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, even if advised of the possibility.

Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or fifty U.S. dollars.

Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

11. Indemnity

If you use the Service on behalf of a business, you agree to indemnify us against claims arising from your content, your use of the Service, or your breach of these terms — including claims by your own employees or customers relating to data you entered.

12. Governing law

These terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Kentucky, and both parties consent to that jurisdiction. Nothing here removes a consumer right you have that cannot be waived under the law where you live.

13. Changes to these terms

We may update these terms. We will change the date above, and for material changes we will give notice in the app or by email before they take effect. Continuing to use the Service after that means you accept the updated terms.
